Acceptance of these Terms

These Terms of Use ("Terms") govern your access to and use of Tamale Marketplace, including the website and any related services (together, the "Platform"), operated by Tamale Marketplace ("we", "us", "our").

By creating an account, posting a listing, sending a message, or otherwise using any part of the Platform, you agree to be bound by these Terms and by our Privacy Policy, which forms part of this agreement. If you do not agree, please do not use the Platform.

We may update these Terms from time to time to reflect changes in our services or legal requirements. Where a change is material, we will take reasonable steps to bring it to your attention, such as a notice on the Platform. Continuing to use the Platform after an update takes effect means you accept the revised Terms.

Important Disclaimers

Tamale Marketplace is a listings platform that connects buyers and sellers -- we are not a party to any transaction that takes place between users, and we do not own, inspect, or guarantee the quality, safety, legality, or accuracy of any item or service listed.

Every transaction is agreed directly between the buyer and the seller, at their own risk. Before completing any deal, we strongly recommend that you:

- Meet in a safe, public place, ideally during daylight hours, and bring someone you trust along.
- Inspect the item in person before paying anything.
- Avoid sending advance payments to someone you have not met or verified.
- Confirm ownership documents for high-value items such as vehicles or property.

Creating an Account

You need an account to post a listing, save favorites, or message a seller -- browsing the Platform does not require one. Registration is free and requires a valid phone number, which we verify by SMS.

You must provide accurate information when you register and keep it up to date. You must be at least 18 years old to create an account, or use the Platform under the supervision of a parent or guardian who agrees to these Terms on your behalf.

You are responsible for keeping your password secure and for anything that happens under your account. If you believe your account has been accessed without your permission, contact us immediately. We may suspend or close an account that breaches these Terms, is used fraudulently, or is created to get around a previous suspension.

What Tamale Marketplace Is (and Isn't)

Tamale Marketplace provides the tools for sellers to list products and services, and for buyers to browse, search, and get in touch with sellers -- nothing more. We do not take possession of any item, hold funds on behalf of a buyer or seller, or act as a broker, agent, or guarantor for any listing.

Each seller is responsible for their own legal and tax obligations connected to what they sell, including compliance with the laws of Ghana.

We may remove a listing, suspend an ad booking or promotion, or restrict access to an account at any time, without prior notice, if we reasonably believe it breaches these Terms, the law, or the rights of a third party. We may also change, pause, or discontinue any feature of the Platform at any time.

Posting a Listing

Posting a listing is free. When you post, you agree that:

- The title, description, price, condition, and location are accurate and not misleading.
- You own the item, or have the right to sell it or offer the service described.
- Photos are genuine images of the actual item -- not stock photos or images taken from another listing.
- The listing is placed in the correct category, and duplicate listings for the same item are not created.
- The content is not offensive, unlawful, or in breach of someone else's rights.

We may decline to publish, or may remove, any listing that does not meet these requirements or that is reported and confirmed to violate our policies (see "Report this listing" on any listing page). Once an item is sold or a service is no longer offered, please update or remove the listing so other users are not misled.

Paid Features: Promotions, Ad Space & Verification

Posting a listing and creating a storefront are always free. Sellers may optionally pay for:

- Promoted listings, which display with a "Promoted" badge and rank higher in search and category pages for the duration purchased.
- Ad space bookings, which display a banner in a chosen placement for a set date range.
- Seller verification, a one-time fee to have your identity and business documents reviewed for the "Verified" badge.

Current rates are shown on the relevant page in your Seller Dashboard before you submit a payment reference. Payments are currently made manually via Mobile Money; a booking or promotion only becomes active once our team has reviewed and approved your payment reference. Fees already paid are not refunded if a submission is later rejected for not meeting our content standards, or if a verified badge is subsequently revoked for a breach of these Terms -- full detail on ad bookings specifically is in our Ad Space Terms & Conditions.

Your Responsibilities as a User

By using the Platform, you confirm that:

- You are legally able to enter into this agreement and are at least 18 years old.
- The information you give us is accurate and kept up to date.
- You will not impersonate another person or business, or misuse another user's account.
- You will not scrape, copy, or use automated tools against the Platform without our written permission.
- You will not use messaging to send spam or unsolicited commercial content to other users.
- Anything you post -- listings, messages, reviews -- is lawful and does not infringe anyone else's rights.

Prohibited Items & Activities

The following may never be listed on Tamale Marketplace: firearms, ammunition, and explosives; illegal drugs and drug paraphernalia; counterfeit or replica goods; stolen property; live or endangered animals and animal parts; hazardous or radioactive materials; adult content or sexual services; medicines requiring a prescription; gambling services; other people's personal data; and any item whose sale is prohibited under Ghanaian law.

The following activities are also prohibited: posting a listing for an item you do not have or do not intend to sell; asking a buyer to pay in advance before you have met or built trust; impersonating Tamale Marketplace staff; collecting other users' personal information without consent; creating multiple accounts to get around a suspension; and any attempt to manipulate reviews, ratings, or verification.

Breaching this section may result in the listing being removed and the account being suspended or permanently closed, and may be reported to the relevant authorities where the law requires it.

Indemnity

You agree to be responsible for, and to cover reasonable costs (including legal fees) arising from, any claim brought against us because of: your use of the Platform; your breach of these Terms or of the law; anything you post; or a transaction or dispute between you and another user.

Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. We do not guarantee it will be uninterrupted, error-free, or completely secure, and we are not liable for indirect or consequential losses -- such as lost profit or lost data -- arising from your use of it.

Where we are found liable for any reason, our total liability to you in any twelve-month period is limited to the fees, if any, you paid us in the six months before the event that gave rise to the claim. Nothing in this section limits liability that cannot be excluded under Ghanaian law, such as liability for fraud or gross negligence on our part.

Intellectual Property

The Tamale Marketplace name, logo, design, and underlying software belong to us and may not be copied, reproduced, or used without our written permission.

You keep ownership of the photos, descriptions, and other content you post. By posting it, you give us a non-exclusive, royalty-free licence to display, reproduce, and promote that content as part of running and marketing the Platform -- for example, showing your listing photo in search results or on a category page.

If you believe something on the Platform infringes your intellectual property rights, please contact us with details of the content and your ownership rights.

Governing Law

These Terms are governed by the laws of the Republic of Ghana, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Ghana.

General Terms

If any part of these Terms is found to be unenforceable, the rest will remain in full effect. Our failure to enforce a provision at any point does not waive our right to enforce it later. These Terms, together with our Privacy Policy and Ad Space Terms & Conditions, are the entire agreement between you and us regarding your use of the Platform, replacing any earlier understanding on the same subject.
